Commercial Court Bengaluru: Arbitrator Appointed by ODR Platform (Presolv360) Is Valid

In MS Retail Private Limited v. Ugro Capital, the mandate of an arbitrator who was appointed by an ODR platform was challenged.

Ruling

The Court held that since no circumstances specified in the Seventh Schedule could be shown, the appointment by the ODR platform is valid and cannot be held to be ineligible. The court specifically stated: "The sole arbitrator appointed through ODR platform, per se, cannot be held to be ineligible under Section 12(5) of the Act."
